Sharing your information

We share your information with third parties to help us use your information as described previously. We also utilize e-commerce, CRM, TMS, and Analytics platforms to improve operational efficiency, enhance customer service, and streamline sales and marketing efforts. Shopify: Shopify is an e-commerce platform that provides tools and services for individuals and businesses to set up and run online stores. Hotjar: Hotjar is a behavior analytics and user feedback platform. Your Data Protection Rights

The right to access: You can request copies of your personal data.

The right to rectification: Users can request corrections to their personal data if it is inaccurate or incomplete.

The right to erasure: Users can request the deletion of their personal data under certain conditions, such as when it is no longer necessary for the purposes for which it is collected.

The right to restrict processing: Users can request to limit the processing of their personal data under certain circumstances, such as when they contest the accuracy of the data.

The right to data portability: users can request to receive their personal data in a structured, commonly used, and machine-readable format and have the right to transmit data to another controller.

The right to object: Users can object to processing their personal data for purposes such as direct marketing, research, or statistical analysis.

The right NOT to be subject to automated decision-making: Users have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects or similarly significantly affects them.

The right to withdraw consent: Users can withdraw their consent to process their personal data at any time if the processing is based on consent.

The right to lodge a complaint:
Users have the right to lodge a complaint with a supervisory authority if they believe their data protection rights have been violated.

Under specific conditions, Rosco Vision may need to disclose your personal data if mandated by law or in response to legitimate requests from public authorities (e.g., a court or government agency)

Rosco Data Privacy Policy

Rosco, LLC (together with its affiliates, collectively “Rosco,” “Company,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the privacy of our users and ensuring compliance with applicable laws through this Privacy Policy.  Applicable laws include the Illinois Biometric Information Privacy Act (BIPA) and the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act of 2020 (CPRA). This Policy describes how we collect, use, disclose, and safeguard personal information, including biometric data, in connection with our driver monitoring services provided to commercial transportation fleets and other customers (each, a “Customer” and, collectively, “Customers”), for use in their fleets of trucks, buses, vans and other vehicles in connection with the Customer’s efforts to make their fleets safer and more efficient.  We refer to persons about whom we collect personal information while in a vehicle operated by a Customer as “you” or “your.”

Information We Collect

We collect the following categories of information, either directly from you, through the camera audio recording devices, equipment and applications installed in vehicles, or from the Customer.

A. Personal Identifiers

  • Names
  • Contact details (email, phone number)
  • Driver’s license number
  • Vehicle identification, assignment and/or fleet identification (e.g., VIN, license plate)
  • Usage data (location, speed, distance traveled)
  • Any other employment related identifying information as provided to us by the Customer
  • QR codes or scan cards that contain or correlate to the information above

B. Biometric Information (Illinois BIPA Compliance)

We collect video and audio from the recording devices installed in vehicles which may capture both images of you and as well as audio of your voice.

We do not currently collect the following biometric identifiers or biometric information

  • Iris or retina scans
  • Fingerprint scans
  • Voiceprint
  • We collect what might be considered biometric identifiers and biometric information in certain jurisdictions, including but not limited to, driver behavior data that could qualify as biometric information when linked with an identifier.  Note that we may use machine learning, machine vision, and/or artificial intelligence to predict distracted or impaired driving behaviors.

Important Note (Illinois Residents):

We collect, use, and store biometric data in compliance with the Illinois Biometric Information Privacy Act (BIPA). See Section 3 below for more information

C. Vehicle and Device Data: We collect the following additional information

  • Geolocation and telematics data
  • Speed, acceleration, braking, cornering, and idle times or parking times
  • Seat belt usage status
  • Camera footage (from inward- and outward-facing cameras, and auxiliary live spot cameras) which can generate raw video footage or photographs
  • Audio recordings where legal and applicable under certain circumstances, particularly involving safety issues
  • Any other available OBDII port industry standard available vehicle data (such as engine RPM, vehicle speed, fuel system status, and diagnostic trouble codes).
  • Livestreamed video and video data upon reasonable request

D. Internet or Network Activity :We also collect the following information

  • Device identifiers
  • Usage data and log files
  • Diagnostic data

E.  Non-personal information :We also collect the following information

  • IP Address
  • Browser type
  • Device information
  • Usage analytics

2. Purpose of Data Collection :We collect and use personal and biometric data for the following purposes

  • Enabling our Customer to monitor driver attentiveness, fatigue, and behavior for safety.
  • Enabling our Customer to detect distracted or unsafe driving (e.g., phone use, eye closure, yawning, eating, lack of seat belt use, etc.). 
  • Enabling our Customer to engage in route optimization and fleet performance analysis.
  • Enabling our Customer monitor and evidence compliance with Department of Transportation (DOT) and other regulatory requirements.
  • Enabling our Customer to engage in incident review and accident reconstruction.
  • Assist our Customer in security and fraud prevention.  Our equipment or services enables our Customers to protect their people, equipment and their reputations.
  • We also collect and use personal and biometric data for improving our systems and services using technologies such as machine learning, artificial intelligence and other developing technologies as applicable

3. Biometric Data Policy (Illinois BIPA Compliance) :If you are a resident of Illinois, the following provisions apply

  • Informed Consent: We will not collect your biometric identifiers or information without the Customer first providing written notice to you and obtaining a written release/consent from you or your authorized agent.  For purposes of this privacy policy, your authorized agent can be your employer or the owner or lessee of the commercial vehicle from which your information is being collection and your consent can be a condition of your employment or continued employment with your employer or your engagement as a contractor. 
  • Disclosure Restrictions: We do not sell, lease, trade, or otherwise profit from biometric data unless explicit written permission is provided by you.
  • Retention Schedule: We retain biometric data only for as long as necessary to fulfill the purpose for which it was collected, or up to three years from your last interaction with our Customer, whichever comes first.  In most instances, the minimum period of time deemed necessary to fulfill the purposes herein is one (1) year. 
  • Reports: In certain instances, reports may be generated that record and correlate events or routes to a particular driver
  • Data Security: We use commercially reasonable standards of care within our industry to protect biometric data, including encryption, access controls, and secure storage.
  • Destruction: Biometric data is permanently destroyed once the retention period ends.
  • Notice: Notice of any changes to our biometric information practices will be received in writing.

4. California Privacy Rights (CCPA / CPRA Compliance) If you are a resident of California, the following rights apply to you A. Your Rights

  • Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you.
  • Right of portability. You have the right, upon request, to obtain your personal information by mail or electronically without charge and in a readily usable format that allows the consumer to transmit the information from one entity to another entity without hindrance.
  • Right to Delete: You may request the deletion of your personal information, subject to certain exceptions.
  • Right to Correct: You may request correction of inaccurate personal data.
  • Right to Opt-Out of Sale/Sharing: We do not sell personal information; however, your personal information is collected using our systems for use by our Customer for the purposes set forth in Section 2. If we ever engage in the sale of your personal information, we will provide a clear opt-out mechanism.
  • Right to Limit Use of Sensitive Information: You may limit our use of sensitive personal information (e.g., biometric data) to what is necessary for our services to our Customer.

5. Sharing and Disclosure of Information We may share your personal information with the following categories of third parties:

  • Our Customer (who may be your employer or fleet operator) (as applicable);
  • Cloud service providers and hosting platforms who are bound to confidentiality by their respective privacy policies (currently we use Amazon Web Services as our cloud service provider and their customer agreement is found at https://aws.amazon.com/agreement );
  • Our Customer’s Analytics and safety monitoring partners, when instructed to by our Customers, who are bound by confidentiality obligations acceptable to Customer;
  • Vendors under contract who are bound by confidentiality obligations;
  • As required by subpoenas and court orders.
  • We do not sell biometric information.

6. Data Security: We implement reasonable administrative, technical, and physical safeguards to protect your data, including biometric data, from unauthorized access, use, or disclosure.

  • Measures include:
  • Data encryption in transit and at rest
  • Role-based access controls
  • Routine security audits
  • Biometric data stored in separate encrypted storage systems

7. Data Retention We retain data as follows:

  • General Personal Information: For as long as necessary to provide services to our Customer or earlier, if necessary to comply with legal obligations.
  • Biometric Data (Illinois): Retained no longer than three (3) years from the user’s last interaction or as required by law

8. Minors

Our services are not directed toward individuals under 18 years of age. We do not knowingly collect personal or biometric data from minors.

9. Changes to This Policy

We reserve the right to update or modify this Privacy Policy at any time. If we make material changes, we will notify you by email or through your employer, or by posting an updated version on our website with a revised effective date.
